All umbilical blood collected for either transplant or research shall follow all applicable law and guidelines applicable to donor confidentiality and security of donor information. All information collected shall be confidential and shall be used solely for the purposes of the Umbilical Cord Blood Collection Program
The department, health care providers, and local health departments shall maintain the confidentiality of patient information in a manner consistent with existing law. Information shall only be used for research to identify risk factors for children's and women's diseases, to develop and evaluate screening tests, to develop and evaluate prevention strategies, and to develop and evaluate treatment.
(1) All information pertaining to umbilical cord blood samples collected and used by the Birth Defects Monitoring Program shall be confidential and used only for the purposes of the program. Confidential information access shall be limited to authorized persons who agree in writing to maintain the confidentiality of information. (2) The department shall maintain a record of all persons who access such confidential information.
To ensure security of a donor's personal information the CPHS shall determine the following have been met before releasing information for research purposes: Birth Defects Monitoring Program contractors or other entities have a plan sufficient to protect personal information from improper use and disclosures, contractors or other entities have a plan sufficient to destroy or return all personal information when it is no longer needed, and contractors or other entities have provided written assurances that personal information will not be reused or disclosed in an unauthorized manner.
