Requires health care administrators to report instances of disciplinary action against licensed medical professionals to the agency. These reports do not act as a waiver of confidentiality of medical records.
In an investigation and prosecution of sexual exploitation by physicians, surgeons, psychotherapists, or alcohol and drug abuse counselors – cannot obtain disclosure of any confidential files of other current or former patients/clients of the individual under investigation.
The Veterinary Medical Board has the authority to place a licensee or registrant on probation. The board may require the licensee or registrant to submit to a complete diagnostic examination by board-appointed physicians. Accordingly, if the board requires a licensee or registrant to submit to that examination, the board shall receive and consider any other report of a complete diagnostic examination given by physicians chosen by the licensee or registrant.
In reinstating a license or registration that has been revoked or suspended, the Veterinary Medical Board may impose terms and conditions to be followed by the licensee or registrant after the license or registration has been reinstated. After a committee in its discretion has determined that a dentist licentiate has been rehabilitated and the diversion program is completed, the committee shall purge and destroy all records pertaining to the licentiate's participation in a diversion program. Treatment records are confidential.
Unprofessional conduct by licensed dental hygienist includes the failure to report to the Dental Hygiene Committee in writing within seven days: (1) the death of his or her patient during the performance of any dental hygiene procedure; (2) the discovery of the death of a patient whose death is related to a dental hygiene procedure performed by him or her; or (3) except for a scheduled hospitalization, the removal to a hospital or emergency center for medical treatment for a period exceeding 24 hours of any patient as a result of dental or dental hygiene treatment.
A registered dental hygienist shall report to the Dental Hygiene Committee all deaths occurring in his or her practice with a copy sent to the Dental Board if the death occurred while working as an employee in a dental office. A dentist shall report to the dental board all deaths occurring in his or her practice with a copy sent to the committee if the death was the result of treatment by a registered dental hygienist.
Any document relevant to the business operations of a licensee, and not involving medical records attributable to identifiable patients, may be inspected and copied where relevant to an investigation of a licensee by the Attorney General or other authorized investigators.
The California Board of Occupational Therapy may deny or discipline a licensee for falsifying or making grossly incorrect, grossly inconsistent, or unintelligible entries in a patient or hospital record or any other record.
