Summary:

Any person applying for a license or the renewal of a license as a professional boxer or martial arts fighter must present HIV and hepatitis C antibody and hepatitis B antigen tests to the commission. Information received under this section and any other medical information about an applicant or licensee shall be confidential and not subject to discovery or subpoena

Summary:

Victims of a sex crime, forensics workers, peace officers/firefighters/emergency medical workers may petition court for health test of subjects if they feel they have been exposed to HIV during crime/in line of duty. If court agrees, defendant/subject will provide specimens, and test results will be sent to victim, victim's employer defendant/subject, officer and chief medical officer in charge of detention center where subject is detained

Summary:

When a local health officer is notified of an illness that can be transmitted by food in a food facility or by an employee of a food facility, the local health officer shall inform the local enforcement agency. The local health officer or the local enforcement agency, or both, shall notify the person in charge of the food facility and shall investigate conditions and may, after the investigation, take appropriate action, and for reasonable cause, require a medical evaluation of any employee, including any laboratory test or procedure, that may be indicated.

A minor under the jurisdiction or control of the Department of Youth Authority is obligated to submit to an AIDS test if the chief medical officer of the facility determines that the minor exhibits CDC recognized AIDS symptoms.

Every person convicted of a sexual offense shall be tested for virus causing AIDS. Results shall be given to the local health officer, who shall make available to defense attorney, prosecuting attorney, and victim upon request.

Summary:

A victim with probable cause of fluid contact with defendant may request HIV testing of the defendant via search warrant. The local health officer will then disclose the results to both the victim and defendant. The victim may disclose test results as necessary to protect personal health and safety or the health and safety of the victim's family or sexual partner. Both the local health officer and victim are required to comply with all laws and policies regarding medical confidentiality and a violation of which is subject to a misdemeanor charge.

Summary:

Upon conviction for prostitution, a court shall order defendant to undergo HIV testing and a report shall made available to the court and State Department of Health Services. At the sentencing hearing, the court shall furnish a copy of the test results to the defendant. Reports of the test results shall be confidential, although Department of Health Services shall furnish copies of any report to a district attorney upon request.

The confidentiality of mandatory tuberculosis test results for correctional institution employees shall be maintained. The Department of Corrections may perform statistical analysis, provided that individuals are not identified.

Summary:

The Department of Correction shall require that all employees receive mandatory annual and pre-employment examination and testing for tuberculosis. Employees testing positive on the skin test shall receive a follow-up examination to set out a treatment plan. The department shall maintain on file physician-signed certifications of employees that they have tested negative.
