Each live birth, fetal death, death, and marriage shall be registered. A report of every judgment of dissolution of marriage, legal separation, or nullity decree shall be filed with the State Registrar.
State Registrar shall adopt regulations to assure the confidentiality of the confidential portion of the certificate of live birth and to assure the confidentiality of the confidential portion of the certificate of live birth, and access to reports
Persons in charge of hospitals or other institutions where patients are admitted for treatment or confinement, must make a record of the patient's personal, medical, and other information adequate for the completion of a birth or death certificate.
This law sets out conditions for release of birth data files, birth data files for public release, death data files for public release, death data files for purposes of law enforcement or preventing fraud, and nonconfidential marriage data files.
The second section of a certificate of live birth shall include medical information to be kept confidential and clearly labeled "Confidential Information for Public Health Use Only." Such information includes: date of first and last prenatal care visit, the number of prenatal visits, description of pregnancy complications and any concurrent illness, and complications during labor and delivery, if such information is essential medical information
Hospital administrators or representative must submit a completed medical and health report pursuant to 102445 to the local registrar for each registration of life birth submitted. The local registrar must submit the report to the State Registrar for filing and shall not be kept on file in the local registrar office.
The medical and health report incident to live births required by section 102445 must be clearly labeled "Confidential for Public Health Use Only." The parent shall be informed of the purposes of collecting information, its confidential nature, and that providing information is voluntary.
Access to medical and health reports portions of birth records is limited to state and local registrar staff, state and local health department staff, and persons with valid educational or scientific interest as determined by the State Registrar and are engaged in studies for health purposes. The department shall maintain accurate records of those allowed access to reports.
Any person whose confidential information section of a birth certificate is released to a person not listed under 102430(a) and has reason to believe such information can be linked with his or her identity, has a right of civil action against the person releasing the information and may seek punitive damages.
